Our world has always been faced with the problem of discrimination. It is one of the most discussed topics nowadays and throughout history. In all countries there is most likely at least one type of discrimination that affects different groups of people. The definition of discrimination is the denial of opportunity or equal rights for a specific group of people that may be differentiated by things such as their religion, color of skin, or gender. My first experience of discrimination w as while I was working in an amusement park as a ride operator and I couldn’t get my salary because of a â€Å"mix up† with my social security card. Although I was completely eligible, people gave me an unnecessarily harder time than other students that looked, acted, or sounded more American. This caused me a lot of time and stress, which was very unfortunate. Almost every day I was standing in long lines, calling and waiting on hold for hours, but nobody wanted to listen or understand me because I was an immigrant that couldn’t talk on their terms. Anyway, instead of losing hope, I just moved forward. To answer the question â€Å"Do I still feel discriminated against as an immigrant three years later?† I would probably say yes. Answer: Introduction There has been an increase in the corporate collapses over the last two or three decades. Most of these corporate collapses are a result of relevant corporate law which had been put in place in order to avoid any wrongdoing which essentially could impact the interest of the company in an adverse manner. But often, the agents or the management of certain companies tend to be driven by their own personal interests which essentially lead to the collapse of albeit healthy entities (Mak, Deo Cooper, 2005). Even though over the years, there have been periodic modifications in the corporate law so as to plug loopholes, but the nature of corporate crimes has also evolved over the years in the Australian context. In order to evaluate the same, certain corporate collapses before the turn of the century would be taken and the same would be compared with corporate scandals in the recent past particularly those which involve bribery related corruption. Besides, in wake of the current challenges and nature of corporate crime, the relevant changes that need to be initiated in the corporate law would also be highlighted. One of the key scandals that took place in the 1980s was the WA Inc scandal which was a political scandal that arose because of the close association between businessmen and government as a result of which a quid pro quo relationship emerged. The scandal resulted in loss to public exchequer to the tune of $ 600 million on account of the bankruptcies witnessed by major corporations in the aftermath of stock market crash that took place in 1987. These corporations were Rothwells, Bond Corporation, Parry Corporation and Bell Group (O'Brien, Webb, 1991). These businesses were owned by selective businessman who were close to the Labour government existing at that time and provided tremendous funding support to the government. The state government in return provided state guarantees to the various assets of the corporations mentioned above at inflated prices which eventually led to losses to the exchequer on liquidation of corporations (Sykes, 1994). A host of breaches in corporate law were observed in this scandal. The most primary being breach of duties by the directors to ensure that their conduct should be driven by care and due diligence directed towards the company. However, the directors indulged in reckless business practices which eventually led to the bankruptcy and hence did not take enough measures to keep the company solvent. Besides, the actions taken by the directors were not in the best interest of the respective companies (O'Brien, Webb, 1991). This is apparent from the dubious business practices of Rothwells which acted as a last resort lender. Further, there was misrepresentation of financial information by the directors and practices related to asset overvaluation and liability minimisation were common so as to keep the stock price artificially high. Also, there were dubious transactions which happened at astronomical valuation which was the case in the sale of Bell Group to Alan Bond in 1987. It was apparent that with these transactions, it was apparent that eventually the corporations would become bankrupt (Sykes, 1994). The dubious conduct of the Bell Group was apparent in the issue of bonds when it was facing financial difficulties. At the time, the group was practically insolvent but still borrowed additional money and hence the directors breached their fiduciary duties by duping investors through the issue of fresh securities. The group along with Alan Bond finally went bankrupt in 1991. However, at the time, most of the assets with the group and its subsidiaries were liquidated by the banks (Allens, 2008). As a result, the directors failed in their fiduciary duty of securing the interest of creditors. This led to the longest case in Australian legal history i.e. WESTPAC BANKING CORPORATION -v- THE BELL GROUP LTD (IN LIQ) [No3][2012] WASCA 157; 44 WAR 1; 89 ACSR 1; 270 FLR 1 which reached settlement only in 2013 with the court directing the banks to return the money it realised through asset sale. In this decision, the court also highlighted that the directors also have the duty to take care of t he valid interests of the creditors even though this is not explicitly mentioned in the law (Hargovan. Harris, 2014). Another corporate collapse which deserves a mention is the liquidation of HIH Insurance in 2001. The company was one of the largest insurance companies in Australia at that time and had rapidly grown in the last decade of the 20th century. However, the company had several issues related to the faulty business practices which eventually led to the demise. The primary concern was the lack of prudent risk management strategy as the company dependent on reinsurance unlike peer companies which adhered to stringent provisioning norms. Besides, the company also indulged in reckless decision making which was apparent in the acquisition of FAI Insurance at a huge premium which made very little business sense (Mak, Deo Cooper, 2005). As a result of this acquisition, Rodney Alder (son of Larry Alder) became one of the directors of HIH insurance. After the liquidation of HIH in 2001, Rodney Adler had to face criminal charges and was found to be in breach of key provisions of corporate law. He was found to have breached s. 999 of Corporations Act 2001 when he gave out incorrect information with the intention of inducing share sale of HIH to certain investors. Additionally, he was found guilty of violation of s. 184(1)(b) of Corporations Act 2001 as his actions were not in the best interest of the company and thus he had breached the duty of the director. Infact the other directors of the company has also breached the duties of the directors by acting in a reckless manner which is apparent from the acquisition of FAI insurance without adequate due diligence. Additionally, the business expansion into risky verticals and new geographies was also not well planned and hence clearly there was breach of fiduciary duties by the directors (Mirshekary, Yaftian, Cross. 2005). Owing to the violation of duties of directors, post the HIH d ebacle, the Corporate Law Economic Reform Program Act 2004 (CLERP) was initiated. This led to sweeping changes in the corporate law in the form of CLERP 9 particularly with regards to corporate governance norms which aims to provide requisite checks and balances to prevent abuse of power (Gay Simnett, 2012). Due to the expanding reach of globalisation, the reach of modern businesses is not only limited to domestic markets but seeks to look at global markets. Australian businesses are also not lagging in this regard and are actively pursuing their business interests globally. However, this global marketplace raises new avenues of concerns for corporate law. While in the past, the root cause of corporate collapse essentially remaining within the national boundaries, same could not be said about the global companies of Australia. As these have business interests across the world, it is difficult for the regulators to keep a close watch on the foreign operations (Heaton, 2015). A case in point is the construction giant Leighton Holdings which through its subsidiary Leighton Offshore is facing investigations from the regulators (ASIC and AFP). In 2012, the company was caught in bribery scandal related to huge kickbacks paid to Iraqi officials through a Monaco based company in order to secure lucrative oil contract (Mckenzie Bachelard, 2016) More recently, accusations of foreign bribery have again resurfaced in connection with a project in India where apparently lucrative sub contracts were promised in exchange for a particular project (Duffy, 2016). Various other countries have also launched investigations into the case as this is fast emerging as a eye opener for national governments (Nicholson, 2016). Another relevant case involves the payment of kickbacks by Australian Wheat Board (AWB) to Iraqi officials for furthering business interests under the aid program (Adams, 2013). Clearly, the above incidents highlight the seriousness of the issue of foreign bribery. The relevant Australian law in this regard initiated with the Commonwealth Criminal Code 1995 which after four years paved way for Criminal Code Amendment (Bribery of Foreign Public Officials) Act. The amendment of the 1995 law was enacted in order to ensure that Australian standards in this regard were at par with the global standards (Adams, 2013). However, the key concern remains enforcement which is apparent from the fact that till 2015, there have been only two companies that have based prosecution. Even in the AWB case, the Australian Federal Police (AFP) did not proceed with the criminal matters investigation because of limited public interest coupled with slim conviction charges. Further, even in the bribery scandal revolving around Leighton, there have been no charges. The result of the lax enforcement in this aspect leads to complacency and the lack of adequate risk monitoring by compani es which are prone to such bribing of foreign officials (Heaton, 2015). The above fears are validated by a Deloitte survey as per which 23% of the firms had experienced incidents of bribes being paid during the last five years. Additionally, 75% of the surveyed Australian firms having foreign operations did not ever conduct any assessment related to corruption risk. Also, of the 25% companies that did carry out an assessment of corruption risk, 40% never initiated any program to manage the corruption risk on a proactive basis. It is apparent from this that the Australian companies lack the necessary internal processes so as to be proactive with regards to payment of foreign bribes and the only action is primarily reactive as is apparent from the Leighton case (Heaton, 2015). In absence of appropriate internal regulations to detect foreign bribery and take effective actions, the onus is on the government to take the requisite measures so that the reputation of Australian businesses is not tarnished in the business world. The continuation of this trend in an unabated form could adversely impact the ability of the Australian companies to bag projects oversees. However, the government till now has not been proactive in this regard. The testimony to this fact is the failure of the government to meet the various obligations that were highlighted at the OECD Convention on foreign bribery. The government has subsequently not been successful in implementation of the various recommendations. Also, the government has not yet come out with a national plan to deal with corruption which it originally proposed to release in 2012 (Heaton, 2015). In wake of the above facts, it is essential that appropriate modifications need to be made so as to curb this menace which could rapidly become out of control. In this regard, the most critical mechanism which needs reforms is the strict enforcement of the existing law. This is because invariably proper and timely enforcement of laws lead to compliance in the long run. In order to overcome the legal hassles related to proving bribery, provision related to books and records can be introduced on the lines of US Foreign Corrupt Practices Act. As a result of this provision, there would be a legal obligation on the companies to maintain detailed records of transactions which would enhance the overall transparency and also improve internal compliance and risk assessment (Adams, 2013). Further, like in UK, any failure in bribery prevention should be treated as a criminal offence. The only defence that the companies could avail is by adhering to reasonable internal controls and reporting nor ms which enhance transparency and accountability. Additionally, whistle-blowers also need to be encouraged in this regard through the implementation of appropriate legislation in this regard. Also the prosecutors should be made extended wider options for settlement like non-prosecution agreement so as to ensure timely settlement (Heaton, 2015). Thus, in wake of the above discussion, it would be fair to conclude that with Australian businesses going global, the focus of corporate collapse has shifted from internal concerns to concerns spanning into foreign territory. In this regard, the current regulations in Australia are not effective due to weak enforcement. Taking a cue from other developed nations such as US and UK, it is the need of the hour that requisite changes must be incorporated in the relevant law and enforcement process so as to enhance the conviction rate. At the very beginning, children did not succeed in focusing on the coach’s tasks because their attention was paid on coordinating their movements so that they could both control the ball and overcome the barriers. However, further practicing allowed children to listen to the coach’s advices to improve the performance. Even though some children were not able to perform at the first time, coach constantly encouraged them. In case a mistake was made, the coach strived to explain how to correct the situation and improve skills. Children were looking at coach to find any sign of approval and disapproval of their actions. In response, the coach was trying to react to each of the children’s actions and improvements to make them sure that they were making progress. At the same time, the coach told children to concentrate on the drilling and practicing of every movement rather than on constant seeking for his approval. During the practice activities, both children were trying to follow teacher’s advice, but his remarks were effective only during the actual process of practicing, but not after the instructions had been given. Probably, most of the children gained a deeper understanding of the activity through personal experience. After ten minutes of dribbling, children start improving their skills. Children successfully react to coach’s recommendations. However, the instructor did not interfere with the process frequently for children to real ize their mistakes, or just get pleasure from the activities. The point that is very much evident with the close reading of the text is that, Louise Mallard is a subject to the masculine discourse of the story. She is introduced as Mrs Mallard and referred to as she for most of the narrative, only once is she called by her own name and that too by her sister, Josephine. As she sits in her room and drinks the very elixir of life, she experiences a new life coming into her, and she realizes that she has now no one who would control her. She was not ouch upset cause of her husbands death but she was actually looking forward to what lies ahead of her. All this shows that she is defined as a selfless woman who is attached or rather affiliated to Presently Mallard as his wife, someone who does not have her own social status and who surely lacks self identity. This feminist reading of the text shows to us the reasons of her facing self effacement in her married life and hence her need for self assertion. It can also be argued that Louise lack of self was just her own issue and the social norms or her marital life did not play a role in it. N only happen when she knows that her identity is at stake because she must have had experienced individuality before her marriage, this probably means that she was satisfied with herself before her marriage and she knew what it is be like an independent woman, but after her marriage this disappeared and she lost the control of herself. Also the whole idea that she starts her self-asse rtion and the possession of herself only after the death of her husband tells us that she was in a way not satisfied with her marriage life and the whole crisis of her lack of identity is because of her husband and her marred life. Day 1 The worst possible has happened I have had my home stricken from me by a white skinned demon and am now delimited to a water bound hell. ROLE OF THE PHARAOH The Pharaoh had many objectives throughout his life on the throne. These activities included keeping order of his people, religion and had many roles as a warrior and a ruler. Akhenaton’s religious beliefs did not last. His was where seen as heretic. When Tutankhamen came into power, within 10 years he restored all beliefs in the gods that Akhenaten ignored. This put all his followers behind him and gained him respect. This can be illustrated through the decorations in Tutankhamun’s tomb. He was seen with various gods, which depicted he believed in number of gods that Akhenaten did not. Further more there were drawings and pictures of the god Hapi and statues of the gods Isis, Nephthys, Serqet and Neith protecting the body of the king. It was important that the Pharaoh had strong relation with the gods and his religion. This showed a power within the pharaoh and provided loyalty by the people of the kingdom. He also had to be a ruler and keep his people in order. He did this through entertainments such as hunting. Evidence of this is found on his chest when he is hunting for animals. Hunting was a way of entertainment and to keep people please in the New kingdom Egypt. Hunting wild animals showed that there was none greater than the pharaoh. This secured his people’s belief and trust in him. There are also statues of the god of Water and Fertility (Hapi). This is an indication that Tutankhamen believed in this god. Therefore the fertility and wealth of the kingdom must have been good. The people of the kingdom had the pharaoh to thank to as a living god. MILITARY Tutankhamen was seen as a warrior in various drawings of him in his tomb. He was seen as a ruler and Ma’ar of the kingdom. Infact he is seen wearing the blue war crown of a pharaoh to indicate his relation with war and hunting. His rule over war and military is also demonstrated in the painting on the sides of his treasure chest, showing him either hunting wild animals or in battle. In the scene he is seen has fighting in a battle on his chariot, with his bow and arrows, he is shown has huge however his enemies much smaller. Tutankhamen was a great influence to his people in war. His ruling power was shown through his mask, which states him as a pharaoh. The mask is made of pure gold and has the two protective animals in it, the cobra and the vulture. However, Tutankhamen has never been involved in a war himself as there is no evidence of any battles. EGYPTIAN SOCIETY Fashion, food, economies, entertainment and fundamental living ways were very advanced and crucial in the Egyptian Society. The Egyptians usually wore white clothing, because white sustained coolness while black sustained heat. Their clothing was made from the stem of the flax plant. The clothing was a symbol of wealth as poor people and workers usually walked around naked and lived naked. Clothing also showed a man’s rank in the society, this depended on how elaborate his kilt was. Kings, gods and higher-class rulers usually wore colourful clothing this showed that they were noble and rich. Therefore clothing performed the role of symbolism for wealth, rank and importance in the society. However as well as clothing, fashion was very crucial. The process of the mummification would take 70 days in total. The body then would be sealed in the pharaoh’s body shaped coffin. In fact the body was put into 3 coffins. 2 made out of wood and the final one pure gold. After 70 days of process, the pharaoh is taken to his tomb and receives the opening of the mouth ceremony. A patial salpiingectomy was preformed. removing the portion of the left fallopian tube containing the ectopic pregnancy. Heaney clamps were replaced with sutures with #1 micro. Hemostasis was checked again and no bleeding was detected. Further evacuation of blood and blood clots was then preformed. the right fallopian tube was noted to be covered with adhesions both tubular variatand tubal uterine The adhesions were then sharply lysed freeing the right fallopian tube. Hemostasis was checked again. No bleeding was detected. Mild cirrhosis abrasion was noted was noted where the area of the ectopic pregnancy was apparently attached to the bowel and not bleeding and was very superficial. hemostasis was checked and no bleeding was detected. Secondly as a female Vive always had to fight for my spot on the team that I was I playing for. To be respected in the mens hockey world I quickly discovered that I had to strive to not only be the best female, but the best hockey player on the ice. This kind of demanding life style was difficult to adjust to at first and the stress, well it could be pretty overwhelming sometimes, but overall out-come and all the strengths that I have gained through it all has made me not only a stronger a hockey player but also a much stronger individual in general. Ill. Transition Statement: So with that said, we move along to next topic at hand, developing an understanding of a mans thoughts and emotions. Now many of you may be wondering what exactly it is I mean by this statement. Well as all of us already know men and woman have efferent ways of thinking; dealing with emotions, and senses of humor. Growing up playing hockey, I ended up having pretty much all male friends; therefore I didnt really get to experience the typical girl lingo, never really had much drama to deal with, and I missed out on all the hot gossip. A. The way I socially interact with people, and my way of thinking along with my smart remarks, and blunt personality come from my experiences hanging out with the guys, and also a majority of it comes from what we like to call locker room talk. Urban Dictionary defines locker room talk s the crude, vulgar, offensive, and often sexual trade of comments guys pass to each other. Exists solely for the purpose of male comedy and is not meant to be taken seriously. This quote sums it perfectly. You learn real quickly not to take things the guys. Now there was a time when I wasnt exactly thrilled about that, but over the years I have developed an appreciation for it. My friends have expressed to me time and time again that its their favorite part about me and its what makes me the strong, down to earth, free spirited, understanding and laid back female I am today. V. Transition Statement: Now let me take you back to where it all began. I was the first born female to my family in almost 3 generations. My father, who is from the east coast, and he grew up playing hockey, made it very clear to me as a child that he was hoping for a son. I wanted to be a dancer, as most little girls do, but no he insisted I played hockey instead. A. I didnt want to play hockey, I wanted to be a princess in a castle, or a mermaid under the sea, but instead I tossed those dreams to the side and proceeded to play hockey. For the first few years I had so much resentment towards my dad. Wouldnt you? As time progressed and I started to understand and develop a strong feel for the game, my resentment slowing started to subside. B. I could of been a dancer or a cheerleader, but because of my dads decision to put me in hockey Ive become a unique, strong, fear less, individual and have broken through so many barriers that most people never thought a female could do. For that, I am so very thankful and as the years fly by, its been what keeps us close. V. Conclusion: As Halley Wisenheimer so wisely stated, People would say Girls dont play hockey. Girls dont skate. I would say Watch this. She proves that Just because we as females are smaller and less competitive by nature doesnt mean we cant overcome these high boundaries and come out on top. Fighting the never ending battle to be accepted and respected in a mans sport, developing the thoughts and emotions off man, and the impact it has made on mine and my fathers relationship over the years are only a few areas in my life that hockey has impacted but they are defiantly the most important.
